These General Contracting Conditions regulate the distance selling relationship between Lucartex SL and the user or client, in accordance with current legal provisions, in particular, Law 7/1998, of April 13, on General Conditions of Contracting, Law 3/2014, of March 27, which modifies the consolidated text of the General Law for the Defense of Consumers and Users, Organic Law 3/2018, of December 5, on the Protection of Personal Data and Guarantee of Digital Rights, the General Data Protection Regulation (EU) 2016/679, Law 7/1996, of January 15, on the Regulation of Retail Trade, and Law 34/2002, of January 11 July, Information Society Services and Electronic Commerce.

Lucartex SL reserves the right to make any modifications it deems appropriate, without prior notice, to these General Conditions. These modifications may be made, through their websites, in any manner admissible by law and will be mandatory during the time in which they are published on the website and until they are validly modified by subsequent ones. However, Lucartex SL reserves the right to apply, in certain cases, Specific Contract Conditions in preference to these General Conditions when it deems appropriate, announcing it in a timely manner.

The duration of the contract will be linked to the delivery of the product, without prejudice to the right of withdrawal.

As a user or client, you expressly declare that you know, understand and accept the conditions of use and these general contracting conditions. During the purchase process, you must identify yourself with your username and password. These data will not be made public. You are responsible for treating the identity and password acquired during customer registration as confidential and responsible and may not disclose them to other users. You may modify the data registered on the website at any time, in your customer area. In this same section, you will have access to a history of your orders. This is only a reference section. However, certain procedures are allowed, such as deleting those records that you no longer consider necessary to view. At the end of the purchase process, you will receive a confirmation of your purchase by email. You must provide a valid email address during the purchase process. Offer and validity

The products offered in our online store include a photograph and the basic characteristics of the products, which is the information provided by the manufacturer. The color of the product, as shown in the photograph, is not binding. The color of the product is identified in its characteristics.

Guarantees

All products offered on the website are covered by the supplier's sales guarantee. Lucartex SL offers an after-sales service that customers can use during the warranty period by contacting the Lucartex SL establishment, the after-sales service, by email sent to info@hookeshop.com, or at the established points by the supplier.

Prices

All products show the sales price in Euros and include Value Added Tax (VAT). If any other tax applies, it will also be indicated (IGIC [Canarian Indirect General Tax] or IPSI [Tax on Production, Services and Imports for Ceuta and Melilla]).

Iberian Peninsula 48 working hours: €7

For orders over €70, shipping will be free in Spain. International shipping will be free for orders over €200.

Please note that the original shipping costs will not be refunded in case of exchange and/or return.

Payment methods

You can pay for your order in any of the following ways. You must indicate which one you choose during the purchasing process:

You will find more information at the following link: http://www.redsys.com/ When paying with VISA or MASTERCARD, you will always be asked for the following information: the card number, the expiration date and a Validation Code that matches the last three figures of the number printed in italics on the back of your VISA or MASTERCARD, which is an additional guarantee for the security of the transaction.

This payment method is only valid on the website.

When the amount of a purchase has been charged fraudulently or improperly using a payment card number, the cardholder may demand the immediate cancellation of the charge. In this case, the corresponding debit and credit entries will be made to the accounts of the supplier and the cardholder as soon as possible. However, if the purchase had actually been made by the cardholder and the demand for a refund was not a consequence of having exercised the right of withdrawal and, therefore, the cardholder had improperly demanded the cancellation of the charge, the cardholder will be liable to Lucartex SL for compensation for damages caused as a result of the cancellation. Exchange costs and bank commissions will be borne by the client.

Service provision

Lucartex SL undertakes to deliver the order within an approximate period of:

- 48 - 72 hours in Spain

- 5 - 15 days (approx.) in Europe

- 5 - 10 days (approx.) for international destinations.

The availability of the products offered by Lucartex SL may vary depending on customer demand. Although Lucartex SL updates the stock periodically, the product requested by the customer may be out of stock at that time. In the event that it is not possible to supply the product due to lack of availability, Lucartex SL will notify the customer by email as soon as it becomes aware of this situation. In no case will the period for sending this notice exceed a maximum of 30 days. Lucartex SL may offer two options: supply the customer with a product of similar characteristics or higher quality at the same price or, except for justified causes that can be proven by Lucartex SL, refund the amounts paid for the canceled order within the same period.

Returns

All items (except Outlet, Black Friday and Accessories) have a free exchange or return per order. For orders destined for the Iberian Peninsula. The period to make the change is 15 (fifteen) calendar days from the day of receipt of the order. For the rest of the items and destinations, the customer will bear the costs of the return.

To request an exchange and/or return, the customer must log in to their customer account, click on order history, select details of the corresponding order, mark the item(s) they wish to return and the units. To complete the return request, you must click on the “Request Return” button

The customer can also go to our store C / Argensola, 5 (Madrid) for any exchange and/or return.

For the rest of the items and destination, the customer will bear the return costs.

Payment refund

The amounts paid by the client will be refunded using the same payment method used by the client, unless otherwise provided. Lucartex SL will refund the amounts paid by the client within 14 calendar days from the date of receipt of the right of withdrawal.

Return of defective products

If the product is not in good condition for reasons not attributable to the customer, the customer will have the right to return the product, informing Lucartex SL of the reason for the return by any of the means provided for in these contract conditions, without no cost to the client.

Returns made for defective or damaged products will not be considered an exercise of the right of withdrawal. Lucartex SL undertakes to pay the cost of the return and to replace the product with a new one under the terms accepted at the time of sale.

Jurisdiction

Likewise, Lucartex SL reserves the right to file civil or criminal actions that it deems appropriate for the improper use of its website and content, or for non-compliance with these conditions.

The relationship between user and supplier will be governed by the regulations in force and applicable in Spain. In the event of a disagreement between the parties, they may submit their conflicts to arbitration or resort to ordinary jurisdiction, in accordance with the applicable rules on judicial jurisdiction. Lucartex SL has its registered office in MADRID, Spain.

Applicable law and jurisdiction

This Legal Notice is governed by Spanish law. Therefore, in the event of a dispute regarding the interpretation of the terms and conditions contained herein and any other issue related to the products and services provided on the Website, it will be resolved in accordance with applicable Spanish legislation.

In the event that any controversy arises arising from the use of the services provided on this Website, the parties, expressly waiving any other jurisdiction that may correspond to them, submit to that of the courts and tribunals of the domicile of the user as long as it is located in Spanish territory.
